Terms of Service

1. Who we are

The Service is operated by LoveSpiel ApS, Lyngby Hovedgade 96, st, 2800 Lyngby, Denmark ("we", "us"). These Terms govern your use of the Lovespiel AI couples counselling service (the "Service"). By purchasing a package or using the Service, you accept these Terms.

2. Nature of the Service

2.1 The Service provides automated, AI-powered couples counselling support, based on the Process Oriented Couple Therapy method, for informational and educational purposes only.

2.2 The Service is not therapy and does not replace professional mental health treatment, medical advice, legal advice, or counselling delivered by a licensed practitioner. It does not create a clinician–patient relationship.

2.3 You acknowledge that reliance on the chatbot's outputs is entirely at your own discretion and risk.

3. Eligibility

3.1 You must be at least 18 years old and legally capable of entering into binding contracts under the laws of your country of residence.

3.2 The Service is not intended for individuals in crisis or emergency situations. If you are in crisis, immediately contact your local emergency services or qualified professionals.

4. Packages and payment

4.1 The Service is sold as one-time packages (for example, a 1-day or 1-month package). There is no subscription and no automatic renewal; access ends when your package expires, and you only pay again if you actively choose to buy a new package.

4.2 Each package gives access to the Service for the duration and up to the number of messages stated at checkout, whichever is reached first.

4.3 Prices are shown at checkout and payment is handled by our payment providers. Access begins immediately after successful payment.

5. Right of withdrawal and refunds (EU consumers)

5.1 As an EU consumer you normally have a 14-day right of withdrawal for online purchases. By purchasing a package, you request that the Service is made available to you immediately.

5.2 If you withdraw within 14 days, we may deduct a proportionate amount for the use you have already made of the Service (for example, messages used or days elapsed) before refunding the remainder. If your package has been fully used or has expired, no refund is due.

6. Fair use and prohibited conduct

6.1 You agree to use the Service lawfully and not to rely on it in place of professional counselling, medical treatment, or crisis intervention.

6.2 You may not copy, scrape, systematically extract, or attempt to extract the Service's underlying method, instructions, prompts, or training materials, and you may not reverse-engineer the Service.

6.3 Access is personal to you (and your partner when you use the Service together). You may not share, resell, or otherwise make your access available to third parties.

7. No warranties

7.1 The Service is provided on an "as is" and "as available" basis.

7.2 We make no warranties, express or implied, regarding:

• The accuracy, completeness, or usefulness of chatbot responses.
• The availability, uninterrupted operation, or error-free nature of the Service.
• Suitability of the Service for any specific purpose.

8. Limitation of liability

8.1 To the maximum extent permitted under EU law, we disclaim all liability for:

• Any decisions, actions, or omissions taken by you or others based on the Service's outputs.
• Any emotional distress, relationship outcomes, or mental health impacts arising from use of the Service.
• Any indirect, incidental, special, or consequential damages, including loss of profits or data.

8.2 In jurisdictions where such exclusions are not allowed, our total liability shall be limited to the lesser of the amount paid by you in the 3 months preceding the claim, or EUR 100. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Intellectual property

9.1 All intellectual property rights in the Service — including the software, design, content, and the Process Oriented Couple Therapy materials it is built on — remain the exclusive property of LoveSpiel ApS and its licensors.

9.2 You are granted a limited, non-transferable licence to access and use the Service for personal, non-commercial purposes only.

10. Suspension and termination

10.1 Your access ends automatically when your package expires or its message allowance is used up, whichever comes first.

10.2 We reserve the right to suspend or terminate your access at any time, without notice, if you breach these Terms.

11. Modifications to the Service and Terms

11.1 We may modify, suspend, or discontinue the Service at any time without liability.

11.2 We may update these Terms periodically. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing law and jurisdiction

12.1 These Terms are governed by and construed in accordance with the laws of Denmark.

12.2 Any disputes are subject to the exclusive jurisdiction of the competent court in the municipality of Lyngby, Denmark.

13. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
